This Policy applies as between you, the user of this website and WMEDED SERVICES LIMITED, the owner and provider of this website and its connected persons.

WMEDED Services Limited is referred to as “WellMedic”, “WellMedic.co.uk”, “us”, “we” or “our” in these terms and conditions.

Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of this website. If you do not agree to be bound by these terms and conditions, you should stop using this website immediately and should not purchase our products or services.

1 Application

1.1 These terms and conditions shall apply to the provision of the free and paid services as outlined in clause 7 by WMEDED SERVICES LIMITED.

 

2 Definitions and Interpretation

2.1 In these terms and conditions the following terms shall have the following meanings;

“Account” means your personal login for this website. This includes the personal information that you share with us, but will not include your payment information as that is stored with our payment provider.

“Advertisement material” means any marketing channel used by WellMedic. This includes, but is not limited to, blog posts, podcasts, emails, WhatsApp, Facebook, Twitter, Instagram, Telegram, and LinkedIn.

“AKT” means the Applied Knowledge Test which forms part of the MRCGP

“SCA” means the Simulated Consultation Assessment which forms part of the MRCGP.

“Customer” means the person who has used our paid or free services.

“Content” means any text, graphics, images, audio, video, software, data compilations, code or any other form of information capable of being stored in a computer that appears on or forms part of this website.

“Courses” means any course which is hosted on our educational platform, wellmedic.co.uk.

“Observer” A subscriber attending the session to watch the whole session and to engage in theoretical learning.

“Participant” A subscriber attending the session to watch the whole session and to engage in theoretical learning. Additionally, they will practice a full case and receive personalised feedback.

“Service” means collectively any online facilities, tools, services or information that WellMedic makes available through the website, email or third-party services either now or in the future.

“System” means, any online communications infrastructure or online material that is made available through the website. This includes, but is not limited to email, discussion posts, comments, podcasts and blogs.

“Supplier” means WellMedic. Registered as WMEDED SERVICES LIMITED.

“User/Users” means, any third-party that accesses the website and is not employed by WellMedic.

“Website” https://wellmedic.co.uk/ and any sub-domains of this site. This also includes https://wellmedic.thinkific.com/ and any sub-domains of this site. These terms and conditions also apply to any domains linked to our third-party applications.

“WellMedic” is the trading name for WMEDED SERVICES Limited.

 

3 Age Restrictions

3.1 Persons under the age of 18 should only use this website with the supervision of an Adult. Payment information must be provided by adult users only.

5 Disclaimers

5.1 Your membership on this website is purely for educational use only. Any opinion, news or research pieces contained on this website or via other advertisement materials is provided as general market commentary and does constitute as exam or clinical advice.

5.2 By viewing any material or using the information provided by WellMedic you agree that is general education material and you will not hold any person or entity responsible for any loss or damages resulting from the content or general information provided.

5.3 For the avoidance of any doubt, WellMedic, its employees, directors or associate members are not qualified medical lecturers, teachers or medical education experts. We are doctors with an interest in the wellbeing of other doctors and an interest in the accessibility of medical education.

5.4 The content available via our courses is restricted to those who have purchased the course. Sharing our content is prohibited without our prior consent. This extends to all of the Google sheets shared via WellMedic.

5.6 Our course, website and advertisement material is provided on a general basis and should not be relied upon or used as the sole basis of making decisions without consulting primary, more accurate, more complete and timely sources of information. Reliance on our material is solely at your own risk.

5.7 We reserve the right to amend any errors on our website without prior notice.

5.8 Disclaimer for the WellMedic revision guides and question bank – Please note that these articles are created to supplement your revision whilst preparing for your medical exams. We make every effort to ensure the information is accurate and correct at the time of publication, but given the brief nature of the articles and the general overview approach, we do not recommend using this article to replace your own clinical judgement, taking professional advice, or using primary, local, or national guidelines. 6 Basis of Sale and Service

These terms and conditions come into effect when either;

6.1 A user completes an online purchase of any material produced by us.

6.2 A user registers or attends a free service.

6.3 A user attends a webinar hosted on a third-party platform by WellMedic.

6.4 A user accesses any content published on the WellMedic website or sent via email.

6.5 A user views any content published on our advertisement material.

7.12 Access to our course is given for 365 days from the time of purchasing courses 7.1, 7.2, 7.3, 7.4, 7.8, 7.9 or 7.10. 

7.13 You continue to extend your 7.10 monthly subscription after the initial 12-month term.

7.14 Access to 7.5 is given on a monthly basis until you unsubscribe with 30 days’ notice.

7.15 Services 7.6 and 7.7 are covered by their own terms and conditions, and you will review and agree to these independently before finalising your service purchase.

Our free services currently include;

7.18 Access to our podcasts which are submitted to our website and third party podcast providers, which include but are not limited to, apple podcasts, spotify podcast and amazon music.

7.19 Whilst every effort has been made to ensure that all descriptions of the services listed in these terms and conditions are met, we are not responsible for any variations from these descriptions.

7.20 Our products are offered through internet services. The quality of the user experience will be dependent on your internet connection. We will not be held responsible for a reduction in video or access quality.

7.21 Our products may be limited to certain customers, and we are not obligated to offer you access to a certain product.

7.22 Our product range is subject to change without prior notice. We reserve the right to modify or discontinue the whole or part of any existing services.

 

8 Price

8.1 The price of goods and services shall be the advertised price on our website.

8.2 If a price is pre-agreed between ourselves and the user, that price shall remain valid for 24 hours and will be honoured using a voucher code.

8.3 The price displayed on the website is inclusive of any applicable taxes imposed by local laws.

8.4 All pricing information on the website is correct at the time of going online. We reserve the right to change prices and alter or remove any special offers from time to time as necessary without any prior notice. All pricing information is reviewed and updated regularly.

8.5 All prices quoted are inclusive of Value Added Tax (VAT) at the time WMEDED services limited is eligible to register for VAT.

8.6 Please see point 13, specifically referencing subscription-based products. If you are not using a subscription-based product, this will not apply to you. This covers the Conclusion of the contract, Term, Renewal and Termination.

 

 

9 Payment

9.1 All payments shall be made at the time of processing the order.

9.2 To process payments, the website uses a third-party payment gateway Stripe, Inc. We do not store your payment data. Payment data is processed by Stripe, Inc. For more information on Stripe, please visit https://stripe.com/gb/checkout/legal

10 Refunds

10.1 Refunds will not be offered if the user has accessed our course or had access to our templates, cheat sheets or PDF lessons.

10.2 If you have not accessed the material stated in 10.1 and have signed up in error, we can offer a full refund if requested within 14 days via email to sham@wellmedic.co.uk.

10.3 Processing your refund may take up to 72 hours. If you access the course, templates or cheat sheets within this time period, the refund will not be applied.

11 Accounts

11.1 You must create an account to purchase and access paid services on this website. Please ensure that all of the information you submit is accurate and truthful.

11.2 It is explicitly forbidden to share your account details. We accept no liability for losses or damages incurred as a result of details shared by you. If you use a shared computer we would recommend that you do not store your login details.

11.3 If anyone else uses your account details to access any products you have purchased, then this will constitute a new sale, and you will be responsible for this payment.

11.4 If you defraud WellMedic by sharing your account details or our paid resources without prior written consent. We will have to inform the General Medical Council of our probity concerns

11.5 If you have reason to believe that another party has obtained your account details without consent, you should contact us immediately so that we can suspend access to the relevant account.

11.6 The account details you share (not including your payment information) may be transferred unencrypted and may involve access over various networks.

 

12 Termination and Cancellation

12.1 We reserve the right to refuse service to anyone for any reason at any time. This includes cancelling any pending orders.

12.2 If we decide to terminate your account, you will be notified by email.

12.3 We reserve the right to terminate without giving reasons.

12.4 If we terminate your account, we will provide you with a full refund. If we terminate a monthly-based subscription (7.5 or 7.10), we will refund a single month’s paid subscription cost only.

12.5 If you choose to terminate your own account and are not eligible for a refund as stated in clause 10, we will issue no refund.

13 Conclusion of the contract, Term, Renewal and Termination

13.1 This clause is specific to the services; 7.5. 7.10 and 7.15.

13.2 The details and pricing in respect of the Paid Subscriptions on the WellMedic service and in our marketing & promotions do not constitute a legally binding offer. By activating the purchase button (or, as the case may be, an equivalent button), you submit a legally binding offer to conclude a contract. The contract is concluded by our explicit confirmation of the contract. If you have not received such a confirmation, the contract is concluded when we provide you with access to the Content within the WellMedic Service.

13.3 If no minimum initial term (e.g. 12 months) is specified at the point of sign-up for your Paid Subscription, your Paid Subscription begins on the day of the conclusion of the contract and has an indefinite term, but can be terminated at any time either by you or by us with a notice period of thirty (30) days. If a minimum initial term (e.g. 12 months) is specified at the point of sign-up for your Paid Subscription, your subscription will initially be for such minimum term and will then continue to be automatically extended by the length of the minimum term (or, if different, on the basis (if any) as was expressly specified at the point of sign-up for your Paid Subscription), unless the subscription is validly terminated by you by providing a minimum of thirty (30) days’ notice, such termination to take effect at the end of the (as applicable) initial or current subscription period. Our right to immediately suspend or terminate your access remains unaffected.

13.3.1 Service 7.5 has no minimum term and is available on a monthly, auto-renewing basis. Termination of the auto-renewal and service requires a notice period of thirty (30) days.

13.3.2 Service 7.10 has a minimum initial term of twelve (12) months, after which it is available on a monthly, auto-renewing basis. Termination of the auto-renewal and service requires a notice period of thirty (30) days.

13.3.3 If you provide notice less than 30 days from your last payment, you will be subject to a final payment before your subscription is terminated.

13.4 You may terminate your Paid subscription by emailing sham@wellmedic.co.uk and this will be considered your providing us notice for the purposes of 13.3 (but for clarity, termination remains subject to the applicable notice periods). Where you have terminated in accordance with section 13.3, you will continue to have access to the subscription plan until the end of your subscription period at which point it will terminate.

13.5 If you have a Free Subscription, your subscription will continue until you terminate it pursuant to this Section 13.5. We can terminate your Free Subscription at any time via email with a notice period of 7 days. You may cancel your Free Subscription by emailing sham@wellmedic.co.uk. You may cancel your Free Subscription at any time.

13.6 To the maximum extent permitted under applicable law, you hereby waive any right of withdrawal you may have under applicable law, and/or you acknowledge you will lose your right of withdrawal if you have streamed Content within the applicable withdrawal period (if any).

13.7 We retain the right to increase your subscription price at any time. If in a fixed contract, the price will increase after your fixed term. If in a monthly contract, this will take place at your next billing cycle. You will not be affected by a price increase if you are eligible for our initial promotion of signing up for service 7.5 before August 2024.

 

14 Specific terms for the service 7.5 (The MRCGP SCA Course & Live Teaching Programme)

14.1 The content and deliverables of the service are highlighted and updated on the advertising page <https://www.wellmedic.co.uk/mrcgp-sca-preparation-course/>

14.2 We retain the right to change, cancel and remove content or deliverables from within the service at any time without reason. If we change, cancel or remove content or deliverables from within the service, we will implement the changes within a two-month period.

14.3 As long as your subscription is active, you will receive two free live educational SCA sessions as an observer.

14.4 If you terminate your subscription without using the two free live educational SCA sessions stated in 14.3, you will lose your right to access the free sessions.

14.5 You are eligible to attend additional live education SCA sessions, but these will be independently charged, and you will be informed of the charge at the time of concluding a booking.

14.6 There is no guarantee that you will be offered participant access when using service 7.5. Participant access will be allocated on a first-come-first-served basis, and an additional participation charge will be added. You will be informed of the charge when you conclude a booking.

14.7 Observers to the live educational SCA session may be given the opportunity at random to practice half of a clinical case (either data-gathering or clinical management), this is not guaranteed to any participant and is a supplementary service depending on the individual session, and this remains at our discretion only.

14.8 Four weeks before the live educational SCA session, you will receive an email with a date for the session. You can book the session using the booking form provided in the email. There will be a booking link for free access and a booking link for additional paid access, if you book using the incorrect link, we retain the right to remove you from the session and void your booking request. If you do not receive this email as a result of, but are not restricted to, software delays, email services, or spam filters, we will not be held accountable for this. It is your responsibility to chase us if you do not receive the booking emails.

14.9 Access to the SCA live session library will be provided from October 2024. Unless on a promotional deal, you will receive conventional access to recordings from two months before your sign-up date and all recordings after your subscription date (as long as you have an active subscription).

14.10 Live recordings will be submitted into the SCA live session library two months after the event unless you are on a promotional deal stating early access. We may choose to offer earlier access at an additional fee.

14.11 We rely solely on third-party software to record our live sessions. If there is a problem with the live session recording, we are not accountable for this loss, and we will not be expected to re-run or re-record the session. If we encounter a technical problem with the recording, we will inform you immediately via email, and we will offer substitute notes from the session if they are available.

14.12 As a subscriber to 7.5, you will be eligible for services 7.7 and 7.11, subject to availability. However, we cannot guarantee any subscriber enrolment in these services as they are limited services.

15 Use of communication facilities

15.1 Users can leave comments and feedback in certain blog posts, forums, podcasts and course lessons. We reserve the right to monitor any and all communications made using our system.

15.2 We may, but have no obligation to remove content that we (at our discretion) consider to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or are deemed to violate another party’s intellectual property.

15.3 You agree that by engaging in our discussions that you will not post comments that violate clause 15.2.

15.4 If you breach the above guidance, we reserve the right to cancel your account and terminate access to all products without offering a refund.

 

16 Limitation of liability

16.1 The user shall indemnify the Supplier against all damages, costs, claims and expenses suffered by the Supplier arising from any losses or damages.

16.2 Using our paid and non-paid services does not guarantee you an exam or MRCGP pass. The content is here to support your revision strategy. We are not to be held responsible for you failing your exam, MRCGP qualification or any component of the MRCGP.

16.3 We accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including indirect, consequential, special or exemplary damages arising from the use of the website or any information contained therein. Users should accept that they use the website and its content at their own risk.

 

17 Force Majeure

17.1 In the event that either party is unable to fulfil its obligation under this agreement by reason of any supervening event beyond its control, including but not limited to war, national emergency, flood, earthquake, lockdown or strike, neither party will be deemed to be in breach of their obligations under this agreement. They shall immediately give notice to the other party if reasonably able to do so.

17.2 WellMedic shall have no liability to the user if it or its third-party software are prevented from or delayed from performing its obligations under this agreement, or from carrying out its business, by acts, events, omissions or accidents beyond its reasonable control, including, without limitations, strikes, lockdown, industrial disputes, failure of a utility, failure of a third-party software or service, failure of transport, failure of telecommunication networks, act of God, war, riot, malicious damage, compliance with any legal or government order. If it is reasonable to do so, users should be notified of the event with the expected disruption duration.

 

18 Changes to these terms and conditions

18. 1 We reserve the right to change the website, its content or these terms and conditions at any time. You will be bound by any changes to the terms and conditions from the first time you use the website following the changes.

  

19 Availability of website

19.1 The service is provided “as is” and on an “as available” basis. We give no warranty that the service will be free of defects and / or faults. We accept no liability for any disruption or non-availability of the website resulting from external causes including, but not limited to, ISP failure, host equipment failure, connection network failure, power failure, third-party software failure or downtime, natural events, acts of war, legal restriction or difficulties of any kind experienced by the website user.

 

20 Intellectual property

20.1 All content on the website is the property of WellMedic. By continuing to use the website you acknowledge that such material is protected by the applicable United Kingdom and International intellectual property and other laws.

20.2 You may only copy and re-use content from our website for personal educational purposes only. Unless you are given prior written permission by WellMedic.

20.3 You agree not to use the content on our website for commercial purposes.

20.4 You agree not to systematically copy the content on this website for the purposes of creating a database, directory, clinical content or exam-based content.

21.1 Some of our products may direct you to third-party websites which we are not affiliated with. We are unable to control the content and accuracy of their website and we are not liable for their materials, websites or products.

24 Governing Law and Jurisdiction

24.1 These terms and conditions and any disputes or claims arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with the law of England and Wales.
